1. Who We Are

2. Introduction
These Terms of Use ("Terms") set out your access to and use of our platforms, including our website, all associated applications, AI chatbot services, content, downloadable materials and related services ("Service"). By using the Service, you agree to be bound by these Terms, along with our Privacy Policy, Cookie Policy, and any other applicable guidelines we publish.
If you're using the Service on behalf of an organisation, you confirm you have authority to do so. We may update these Terms from time to time. If the changes are material, we'll let you know through the platform or email. Continuing to use the Service means you accept the updated Terms.
3. Eligibility & Your Account
3.1 Eligibility. The Service is intended for users who are at least 18 years old and capable of entering into binding agreements.
3.2 Account Registration. Certain features require an account. Please keep your details accurate and up to date.
3.3 Account Security. You are responsible for keeping your login details secure and for any activity under your account. Please notify us promptly if you suspect any unauthorised access.
3.4 Account Closure. We may suspend or close your account if you breach these Terms or if we need to protect the Service or users.
4. About the Service
The Service offers guidance, insights, and content generation. It is designed to support your work, but it is not a substitute for professional advice.
We may provide AI-powered services that generate insights and content to help you work faster. AI may occasionally produce incorrect or incomplete outputs. Always use your own judgement and verify information where necessary.
Hypergility may modify, enhance, discontinue or retire any part of the Service at any time. Where changes are material, Hypergility will provide reasonable notice via the relevant Service platform or email. You acknowledge that the Service is expected to evolve, and features may be added or removed from time to time.
5. Our Intellectual Property
All platform content—text, tools, design, code, features, and branding—is owned by or licensed to Hypergility. You may not copy, reuse, or distribute it without permission.
5.1 AI-Generated Content. You may use AI-generated outputs internally and solely for your business purpose, but you may not:
- use them to train or build competing AI systems, or
- create datasets or compilations that replicate our proprietary methods.
5.2 Downloadable Reports. Reports and materials are for your internal business purposes only. They may not be shared, sold, or republished without our consent.
5.3 Trademarks. You may not use Hypergility branding without permission.
5.4 Feedback. If you share feedback or suggestions, we may use them freely.
6. Your Content & Acceptable Use
6.1 User Content. You retain ownership of any materials you upload or input. By submitting content, you grant us permission to process it to operate the Service. You confirm you have the rights to upload anything you submit.
6.2 Acceptable Use. You agree not to:
- break any laws
- attempt to access systems you're not authorised to use
- reverse-engineer or disrupt the Service
- upload malicious or harmful content
- impersonate others or submit false information
- misuse the Service to create unsafe or infringing content
- use outputs to train or improve competing AI models
7. Third-Party Technology
The Service uses third-party AI models and tools. Their terms may also apply. We aren't responsible for third-party websites, systems, or providers.
8. Fees & Subscriptions
Some features may require payment. Fees are displayed at checkout and charged in the currency shown. Subscriptions renew automatically unless you cancel before renewal. Fees are generally non-refundable unless required by law. Applicable taxes (including VAT) may apply.
9. Disclaimers & Limits of Liability
The Service is provided "as is" and "as available." We do not guarantee:
- uninterrupted access,
- error-free operation,
- accuracy of AI outputs, or
- suitability for your specific use case.
To the fullest extent permitted by law, Hypergility is not liable for any indirect, incidental, or consequential losses. Our total liability is capped at the greater of £100 or the amount you've paid in the last 12 months. Nothing here limits liability for fraud, negligence causing death or personal injury, or anything else that cannot legally be limited.
10. Indemnity
You agree to indemnify Hypergility for any claims arising from your breach of these Terms, your content, or your misuse of the Service.
11. Privacy & Data Protection
Our handling of your personal data is governed by our Privacy Policy. We follow applicable data protection laws including UK GDPR. Do not input sensitive or confidential information unless necessary.
12. Confidentiality
Any non-public information we share with you is confidential. This does not apply to information that is public, already known to you, independently developed, or required by law.
13. Ending Your Use of the Service
You may stop using the Service at any time, and you can cancel subscriptions through your account settings. We may suspend or end your access if you breach these Terms. Provisions that naturally survive termination (such as confidentiality and IP protections) will continue to apply.
14. Disputes
Let's try to resolve issues informally first. If needed, disputes may be referred to CEDR mediation. The courts of England and Wales have exclusive jurisdiction.
15. Governing Law
These Terms are governed by the laws of England and Wales.
16. General
These Terms form the entire agreement between you and Hypergility. If any part is invalid, the rest stays in force. You may not assign your rights without consent. We are not responsible for circumstances beyond our control. Notices to you will be sent to your registered email.
