Hypergility Use Policy
Effective date: 1 February 2026
This Use Policy explains how you may access and use Hypergility websites, content, and services ("Services"). It sits alongside our Terms of Use, Privacy Policy and Cookie Policy. If anything here conflicts with our Terms, the Terms control. Our Terms already prohibit automated access like robots, spiders or scrapers, and the use of our content or outputs to train competing AI models.
1) Scope & permission to use
You may browse our public pages for your own information and evaluation. Unless we grant written permission or provide an API licence, you must not copy, download, extract, or re-use our content at scale. Any rights not expressly granted are reserved.
Important: This policy applies to everyone—humans, bots, and large-scale systems—regardless of user-agent declaration or IP origin. It also applies to text, images, code, datasets, page structures, and metadata.
2) No scraping or bulk extraction
You must not (without our written licence):
- Crawl, scrape, spider, or harvest our pages, assets, or metadata.
- Use automated tools to copy, cache, frame, or mirror substantial parts of the Services.
- Perform text-and-data mining (TDM) or similar bulk extraction on any part of the Services.
- Circumvent, disable or work around rate limits, bot management, or other access controls.
These restrictions are in addition to the automated-access prohibitions in our Terms.
Note on mandatory exceptions: Nothing here limits non-waivable rights under applicable law (for example, narrow "fair dealing" exceptions). Those are interpreted strictly. Contract terms remain enforceable to the maximum extent permitted.
3) No AI / model training or evaluation use
You must not use our site, content, data, or outputs to train, fine-tune, evaluate, or improve any AI, ML, LLM, foundation model or similar system; to create embeddings, datasets or corpora; or to benchmark models. This prohibition includes any compilation of our content or outputs, and is consistent with our Terms' model-training restriction.
If you believe you have a legitimate research or archival purpose, contact us for a written licence before any access.
4) Machine-readable signals & technical controls
We publish bot and AI-crawler directives via robots.txt and HTTP headers (e.g., X-Robots-Tag), and we operate bot-management and rate-limiting at the edge. Accessing materials on our website in ways that disregard these signals or defeat our controls is a material breach of this policy and our Terms.
5) Limited developer access (by licence only)
If you need programmatic access, ask us for an API or data licence. Licences may include authentication, volume caps, permitted fields, retention limits, and audit rights. Unlicensed programmatic access is prohibited even if technically possible.
6) Attribution & IP reservations
All content is protected by copyright and database rights. You may not remove notices, watermarks, or other provenance signals. We reserve all rights, including against unlawful extraction and re-utilisation.
7) Enforcement & remedies
We enforce this policy using technical, contractual, and legal measures, which may include:
- Blocking or throttling offending traffic, user-agents, ASNs or IP ranges at network edge.
- Revoking access to Services and terminating accounts.
- Preserving logs and issuing notices to hosting providers, CDNs, search/LLM providers, and app stores.
- Civil action for injunctive relief, damages, and costs; and referrals to regulators or law-enforcement where appropriate.
8) Reporting abuse & licensing requests
- Report suspected scraping, bot activity, or model-training use: help@hypergility.com (Subject: "Enforcement – Use Policy").
- Licensing & API requests: help@hypergility.com (Subject: "Licence Request").
- Rights & takedowns: help@hypergility.com (Subject: "IP/Takedown").
This inbox is monitored by our Operations and Legal teams. It's the fastest route for both urgent blocks and formal notices.
9) Changes to this policy
We may update this Use Policy from time to time. Material changes will be highlighted on this page. Your continued use after changes take effect means you accept the updated policy.
